Ligas v. Maram Update
The State and the plaintiffs have reached a new proposed Consent Decree. Under the agreement, only people who have a current record of wanting community services will be a member of the new proposed class. If the agreement is approved by the judge, it will allow people living in private ICF-DDs with nine or more residents to move into the community over a six year period. People who are happy with their current ICF-DD placement would not be part of the proposed class and would not be forced to move.
Also, the State will provide community services or community placements to 3,000 people with developmental disabilities currently living in the family home awaiting services.
To ensure that they are part of the new proposed class, people with developmental disabilities and/or their legal guardians need to make a record with the State confirming their desire for community services. A form that people with disabilities or their guardians can use to make a record of their desire for community services is attached.
